The Dutch version of this text is the source. If the two versions differ in meaning, the Dutch version prevails.
Is something on Refinds that you hold the rights to, and would you like it removed or credited differently? This page describes how to report it and what we do with your report.
We take this seriously and act quickly. You do not need a lawyer to file a report.
| Situation | Example |
|---|---|
| Copyright | A photo or text of yours appears on Refinds without your permission. |
| Image rights | You are recognisable in a photo and do not want that. |
| Trade mark or trade name | Your trade mark or trade name is used in a way that goes beyond naming your business. |
| Objection from a source | You run a website, directory or event calendar and believe Refinds uses data from your collection in an impermissible way. |
| Incorrect or unlawful content about you | See disclaimer §7 or, if it concerns your personal data, privacy statement §12. |
The last row does not belong in this procedure, but is listed so that you do not start in the wrong place.
To assess a report we need:
The more complete your report, the faster we can act. Not sure you have everything? Send it anyway and we will ask for what is missing.
Where to send it. Send your report to support@refinds.eu, with "Third-party rights notice" in the subject line. A formal cease-and-desist letter can also go to the postal address in privacy statement §1 (identification); it is handled via support@refinds.eu. This is the only reporting channel; it is the same address we name in the app stores and in the terms and conditions.
Target times:
| Step | Period |
|---|---|
| We confirm that your report has arrived | within five working days — the same period as in privacy statement §13, which is the leading document on this point |
| We tell you what we decided | within ten working days of your report being complete |
| Clear-cut case where continued use could cause harm | immediately, without waiting for those periods |
These are target times, not guarantees: Refinds is maintained by one person, and a report that requires checking with third parties can take longer. If it does take longer, we say so within the period rather than going quiet. The clock for the decision starts once your report is complete — if something from §2 is missing, we ask for it and the clock starts with your addition.
Interim measure. Where a report appears correct at first sight and continued use could cause harm, we take the content down first and assess afterwards. That is not an acknowledgement of your claim and not a judgement on the other party.
If your photo, text or listing has been removed and you believe that was wrong, tell us through the same channel. State why you believe you have the right to use the content. We put your response to the reporter and decide again. If the parties continue to disagree, that is a dispute between them; we are not the court and will not become one.
If a user or shop owner repeatedly posts content they have no right to, we limit their ability to post or close their account. See house rules §7 and portal terms of use §8.
We also take the reverse situation into account: reports that are demonstrably unfounded or made in bad faith are weighed when the same reporter files further reports, and we may suspend the handling of manifestly unfounded reports by the same reporter after a warning; see terms and conditions article 8.
If you run a website, directory or event calendar and believe Refinds uses data from your collection in a way you do not want, tell us through the same channel. State which source is concerned and where you saw the use.
We always take such a report into consideration. In doing so we can trace, per item of data, where it came from, because we record that per field. Depending on what we establish, we remove the data concerned, obtain it from another source, or explain why we believe the use is permitted. In all cases we respond substantively — including where we disagree with you.
If we receive a formal cease-and-desist letter, we acknowledge it within five working days, take the content down in the meantime where the case is plausible, and reply in writing. That we do so is not an acknowledgement (see §7).
