Terms and conditions
Last updated: 22 October 2026
Version: 1.0
Valid from: on the public launch of Refinds (date to follow)
Previous versions: none; this is the first version.
These terms and conditions govern the use of Refinds: the website, the app and the portal for shop owners and organisers. They are written to be precise, not to alarm. Where a word has a fixed meaning, that meaning is given in article 1.
In addition to these terms, two groups are subject to further rules:
How those documents relate to these terms is set out in article 2.
1. Definitions
In these terms, the following words, with or without a capital letter, always have the same meaning:
- Refinds, we, us: the provider of the service, named in article 18.
- The service: the whole of the website (refinds.eu and the addresses that fall under it), the app and the portal, with all their functions.
- The guide: the whole of the listings of shops and markets that Refinds compiles and displays on the website and in the app.
- Listing: the whole of the data about one shop or one market series in the guide, including the description and the photos.
- The app: the Refinds app for iPhone and Android, distributed through the Apple App Store and Google Play (the app stores).
- The portal: my.refinds, the environment within the website in which a listing holder manages their listing.
- User, you: anyone who uses the service, with or without an account.
- Account holder: a user with an account in the app or in the portal.
- Shop owner and organiser respectively: the owner or manager of a shop or a market, respectively, that appears in the guide or is being submitted for it.
- Listing holder: the shop owner or organiser who has claimed and manages a listing.
- Business user: a user who uses the service in the course of a profession or business, in particular a shop owner, organiser or listing holder acting for their business. A user who does not act as a business user is a consumer.
- Find: a photo that a user shares in the app, together with the associated data.
- User content: everything that a user adds to the service themselves: finds, profile photos, display names, list names, photos and texts in the portal, submissions, tips and corrections.
- Additional terms: the house rules of the app and the portal terms of use, and any terms for an additional service as referred to in article 10.
- The automated chain: the process by which Refinds collects, checks, describes, translates and publishes data.
- Reporting: informing Refinds that something is wrong with content in the service.
2. Applicability and order of precedence
- These terms apply to every use of the service. By using the service, you accept them. They can be consulted at any time via the footer of the website and via the Legal section of the app.
- Anyone who creates an account, in the app or in the portal, expressly confirms on creating it that they accept these terms. We record which version was accepted and when.
- Anyone who posts photos in the app is also subject to the house rules and the licence in article 7; the app asks for express acceptance before the first upload. Anyone who manages a listing is also subject to the portal terms of use and the same licence; the portal asks for acceptance when the account is created and reminds you of it at the upload field.
- If these terms and any additional terms conflict, the additional terms prevail, but only for the subject they govern.
- Provisions that are more favourable to consumers under mandatory law continue to apply to consumers. Where these terms lay down a rule for business users only, this is stated.
- The Dutch text of these terms prevails. Translations are a service to the reader; in the event of a difference, the Dutch text applies.
3. What Refinds is, and what it is not
- Refinds is an informational guide to vintage, second-hand, brocante, antique and charity shops and the markets that go with them. We show where those shops and markets are, when they are open and what they are known for.
- Refinds is expressly not:
- a marketplace: you buy nothing through Refinds and we do not broker transactions;
- a review platform: we show no user ratings or stars;
- a booking or payment service.
- No agreement between you and a shop or organiser arises through Refinds. Whatever you agree with a shop or organiser stands entirely apart from Refinds and from these terms.
- A listing in the guide is not a recommendation and not a judgement. Shops and markets appear in the guide because they exist and fit the categories of the guide.
4. Use of the service and accounts
- Searching, browsing and using the guide on the map is free and requires no account. A shop or market can also be submitted, or a correction passed on, without an account.
- A free account is needed to share lists and finds in the app and to manage a listing in the portal.
- Only a person aged 18 or over may create an account. No age limit applies to using the service without an account; the service is not aimed at children.
- Signing in is passwordless: with a one-time code by email, or via Apple or Google. You are yourself responsible for access to your mailbox and to the accounts you sign in with. We attribute to you whatever happens through your account until you notify us that your access has been misused.
- A business user who uses an account on behalf of a business declares that they are authorised to bind that business.
- When creating and using an account, you provide accurate data and keep it up to date.
5. Permitted and prohibited use
- You use the service as it is intended: as a guide for people. In any case, you do not do the following:
- harvest, crawl or otherwise copy in bulk the website, the app or the interfaces behind them in an automated manner, by whatever means;
- load search, filter or programming interfaces so heavily that the service falters for others, or circumvent security or access measures;
- impersonate someone else, or claim a shop or market that is not yours;
- use the service to threaten, defame, harass or deceive others;
- use the service for anything contrary to the law or to the rights of others.
- Linking to pages of the website is free, including to pages deeper in the site.
- Embedding a page of the website in another website (for example in a frame) is permitted, including for commercial purposes, on the following conditions:
- the page is displayed unaltered and in full, with the name Refinds visible and a working link to the original page;
- the page is not displayed in a misleading or offensive context, or in a context harmful to Refinds, a shop or an organiser;
- the embedding is not used to take over data in bulk or to circumvent the restrictions of paragraph 1;
- Refinds may withdraw this permission for a particular website or in general; after notice of this, you stop the embedding within ten days.
Content of the app cannot be embedded.
- Text and data mining and AI training. Our collection, arrangement and texts are protected. We expressly reserve the right to prohibit text and data mining of our content, including its use for training AI models, and we also make that reservation known in machine-readable form. Would you like to obtain data or build an integration? Get in touch (article 17).
- We may take technical measures against use that is contrary to this article, such as limiting the number of requests or blocking access.
6. The data in the guide: no warranty
- Refinds compiles the guide with its own editorial team, on the basis of public sources, its own research and visits, and what shop owners and organisers supply themselves, partly with automated tools. More about this is set out in the disclaimer.
- We make an effort to keep the guide accurate, complete and up to date, but we do not warrant this. A guide to tens of thousands of independent shops and markets is never entirely up to date: a shop may be unexpectedly closed, move or cease trading; a market may be relocated or cancelled; opening hours change without anyone reporting it.
- Opening hours, day status, distances, routes, map positions and classifications are compiled with care, but remain approximations and may change without notice.
- You cannot derive any rights from the data in the guide. Always check what matters to you, opening hours above all, with the shop or the organiser directly before you set out.
- Do you see an error? Report it to us (article 17). We confirm your report and let you know what we have done with it, even if we decide to change nothing; the time limits are set out in privacy statement §13. If you are a shop owner or organiser, you can also take over and manage your listing yourself via the portal.
- Refinds’ liability for the data in the guide is governed by article 13.
7. User content: rights and licence
7.1 Who posts what
User content is everything you add yourself: via the app, via the portal or by sending it to us.
7.2 Your rights remain yours
Everything you post remains yours. You do not transfer any copyright to Refinds. What you do permit us to do is set out below.
7.3 Licence for photos and own texts
- By posting a photo or a text of your own (such as a description written by you), you grant Refinds a non-exclusive, worldwide, royalty-free licence to:
- store, reproduce, reduce, crop and technically convert that photo or text, and strip it of location and camera information;
- edit it editorially, combine it with other photos, texts and map material, and include it in collages and videos; and, for texts, translate it into the languages in which the service is offered;
- make it public and display it through the channels of Refinds: the website, the app, Refinds’ own accounts on social media platforms, and Refinds’ own editorial articles and videos, including announcements by Refinds itself on those channels.
- The licence does not include: use in paid advertising for third parties, printed matter, sale or transfer of the photo or text to third parties, or any use outside the channels in paragraph 1.
- Refinds may pass the licence on (sublicence) only to service providers and platforms, and only in so far as this is technically necessary to store and display the content through the channels in paragraph 1, such as hosting providers and the social media platforms on which Refinds publishes.
- Refinds credits your name or display name where reasonably possible. You accept that a credit is not always possible, for example in a reduced view, in a collage or in a video.
- You accept that Refinds edits your photo or text as described in paragraph 1. Refinds does not edit in a way that puts you, the business depicted or the person depicted in a bad light.
- The licence lasts for as long as the photo or text is in the service. If you delete the content, or your account is terminated, Refinds does not post the content again and does not use it in new publications. Publications that have already been made before that moment (such as a social media post, an article or a video) may remain, as may copies held by third parties or in intermediate storage (cache) over which Refinds has no control. In our back-ups a deleted photo remains for no more than 14 days, and in a monthly copy for up to 12 months; if we ever restore a copy, we delete the content again.
- For photos on a listing in the portal the following also applies: if your management of the listing ends, a photo you posted remains on the listing until you or Refinds delete it; see also article 14 paragraph 6.
- AI. Refinds uses user content for two automated purposes: the check before publication (article 8) and drafting or improving the description of a listing on the basis of factual data. Refinds does not use user content to train AI models and does not pass it to third parties for that purpose.
7.4 Factual data, submissions, tips and corrections
- Factual data that you enter or pass on about a shop or market (such as address, opening hours, contact details, dates and prices) is not a protected work. You permit Refinds to include that data in the guide, to check it, to improve it, to combine it with other sources and to translate it.
- Refinds may freely use, adapt, adopt in whole or in part, or refuse a submission of a shop or market, a tip or a correction, without payment and without the sender deriving any rights from it. Refinds is not obliged to include a submission or to respond to a tip, but does confirm every report (article 6 paragraph 5).
7.5 What you warrant
By posting content, you warrant that:
- the content is your own, or that you demonstrably have the right to have it published and used as described in this article. Note: a photo that a photographer took for you often remains the photographer’s, unless you agreed otherwise;
- the content infringes no rights of others: no copyright, trade mark right, portrait right or privacy;
- people in the picture: passers-by who happen to appear in the picture are permitted. If a recognisable person is the subject of the photo, you have their permission. If a child is the subject of the photo, you have the permission of a parent or guardian;
- the content complies with the law, with these terms and with the additional terms that apply to you.
7.6 Responsibility and indemnity
- You remain responsible for what you post. Refinds checks content before publication in an automated manner (article 8), but that check does not relieve you of your own responsibility.
- If a third party makes a claim against Refinds because content you posted conflicts with a warranty in article 7.5, you indemnify Refinds against the reasonable costs and the loss that result directly from it. This indemnity applies only in so far as the claim is the result of your own breach; it does not apply in so far as the loss was caused by Refinds itself. For consumers it applies, moreover, only in so far as mandatory law permits.
- Refinds may refuse, remove or make invisible content that conflicts with these terms, with the additional terms or with the law; see article 8.
7.7 Editorial control
- Refinds decides, as editor, what belongs in the guide. We may refuse, shorten, adapt, move or remove user content for editorial reasons, such as quality, relevance, topicality, duplication, or because a photo does not fit the listing to which it is linked. No breach of these terms is required for this.
- Texts that Refinds writes itself, including the description of a listing, we always adapt at our own discretion. A listing holder can ask for a rewrite or supply a text of their own in accordance with the portal terms of use; that text of their own is also subject to paragraph 1.
- If we remove or restrict user content, we briefly tell whoever posted it why (article 8 paragraph 4); an editorial reason is a full reason for this purpose. If we refuse content before publication, you see that immediately.
8. Reporting content, checks and moderation
- Do you see something on Refinds that should not be there? Report it.
- Copyright, portrait right, trade mark right or an objection from a source: use the notice procedure for third-party rights.
- Inappropriate or unlawful content in the app: use the report button in the app, or see house rules §6.
- Incorrect data about a shop or market: see article 6 paragraph 5.
- For reports about content, including from authorities, support@refinds.eu is our point of contact; a report can be made entirely by email. This address is also the point of contact for the authorities of the Member States, the European Commission and the European Board for Digital Services.
- How we check. Every photo is automatically assessed before publication for inappropriate content and against the rules of article 7.5; texts supplied by listing holders are assessed for length, unwanted phrasing and spam. If content is rejected, it is not kept and you see that immediately. This check is not infallible; that is why the report button and the notice procedure exist, and why we keep watch ourselves.
- What we do with a report, and how we give reasons for a decision. We assess every report in a timely and diligent manner and without arbitrariness, and we let the reporter know what we are doing with it. If we remove or restrict user content or an account, for whatever reason (a report, our own finding, a breach or an editorial reason as referred to in article 7.7), we briefly tell the person concerned which ground we applied, and they can respond via the same address. Target time limits are set out in the notice procedure.
- In the case of a report that appears well founded on its face and where further use may cause harm, we first take the content down and assess afterwards. That is not an acknowledgement of the report and not a judgement on the party who posted the content.
- Reports that are demonstrably unfounded or made in bad faith, we take into account in later reports by the same reporter, and we may suspend the handling of manifestly unfounded reports by the same reporter after a warning.
- We take our decisions about content on the basis of these terms (including the editorial freedom of article 7.7), the additional terms and the law, and they are taken or reviewed by a human.
9. Refinds’ rights in its own content
- The design, the texts we write, the icons, the name and the wordmark Refinds and the software of the service belong to us or to our licensors.
- The guide as a collection, its arrangement and our descriptions are protected, among other things as a database. Copying or reusing them requires our permission, except where the law permits it without permission, for example the right of quotation for editorial purposes with attribution, and the linking and embedding of article 5.
- Individual facts from the guide, such as that a shop exists, where it is and when it is open, belong to no one. What we protect is our collection, our arrangement and our text.
- Photos and texts that shop owners, organisers or users have supplied themselves remain theirs (article 7.2).
- Map material belongs to OpenStreetMap contributors and to our map-imagery service; the attribution appears with every map. For third-party photos that we display, the photographer and the licence appear on the image credits page for that photo.
10. Costs and additional services
- Use of the guide, the app and the portal as described in these terms is free of charge. A listing in the guide is free and stays free.
- Refinds may offer additional services in the future, whether or not for payment. Separate terms will then apply, which we will present clearly before you take up the service and which, for that subject, prevail over these terms. No one is obliged to take up an additional service.
- Payment does not influence the guide. Whether a shop or market appears in the guide, in what order it appears and what the description says never depends on a payment. If paid placements ever appear, they are clearly marked as such at the place where they appear.
11. Availability and changes to the service
- We make an effort to keep the service available and working, but we do not warrant uninterrupted or error-free availability. Maintenance, faults and changes are part of it.
- We may change, add or discontinue features. Where account holders depend on a feature, we announce this at least 30 days in advance, unless a change has to take effect sooner for reasons of security, law or technical necessity.
- We may take the service or a part of it out of use temporarily for maintenance or in the event of a fault, and temporarily restrict access in order to protect the service, the data or other users.
12. The app and the app stores
- You download the app through the app stores. The app stores are not a party to these terms and are not responsible for the service, for maintenance or support of the app, or for the content of the guide. Direct questions and complaints about the app to Refinds (article 17).
- The standard licence agreement of the relevant app store also applies to the software of the app. It governs only your use of the software on your device; the service itself is governed exclusively by these terms.
- When using the app, you also comply with the terms of use of the app store from which you downloaded it.
- The app works without an account; features that require an account are set out in article 4. What data the app processes is set out in the privacy statement.
13. Liability
This article is the only place where Refinds’ liability is governed. Other documents in this set refer to it and do not repeat it.
- Refinds is a free information service. We are not liable for loss arising from use of the guide, from incorrect, incomplete or outdated data, from temporary unavailability, from the content of websites we link to, or from what happens on a visit to a shop or market.
- User content. Refinds stores user content and displays it at the request of the user who posts it. We are not liable for that content as long as we have no knowledge of its unlawfulness, and, after a report or once we otherwise obtained knowledge of it, we promptly remove it or disable access to it. What you report for this purpose, and how, is set out in article 8.
- The exclusions in paragraphs 1 and 2 do not apply in the event of intent or deliberate recklessness on our part, nor in so far as mandatory law, in particular consumer law and liability for personal injury, prohibits an exclusion or limitation.
- If Refinds is nevertheless liable despite the above, our liability is limited to direct loss and to no more than € 500 per event, where a series of connected events counts as one event. This limitation does not apply where the law prohibits it (paragraph 3).
- For business users it also applies that Refinds is never liable for indirect loss, such as lost turnover or profit, missed savings or damage to reputation.
- A claim against Refinds lapses twelve months after the user became aware of the loss. This period does not apply to consumers in so far as the law mandatorily prescribes a longer period.
14. Suspension and termination
- By you. You can stop using the service at any time. You delete an app account yourself in the app (Profile › Delete account); a portal account you have deleted via the contact address (article 17), which we carry out within one month. See privacy statement §5.6 and portal terms of use §10.
- By Refinds, for cause. If you act in breach of these terms, the additional terms or the law, we may restrict your use, remove content, withdraw your access to a listing or suspend or close your account. We do so as narrowly as possible and in proportion to the seriousness. In the case of a first, minor breach we warn first; in the case of serious or repeated misuse we intervene immediately.
- If we restrict or close for cause, we tell you on what ground, and you can object to it via the contact address. We reassess your objection and let you know the outcome.
- By Refinds, without cause. Refinds may also terminate an account or a feature without your having done anything, for example because a feature or the service is being discontinued. We announce this at least 30 days in advance.
- Consequences in the app. If an app account ends, your finds, your profile and the lists of which you are the owner disappear.
- Consequences in the portal. If your management of a listing ends, the listing itself remains in existence as part of the guide in its last known state; only your access lapses. Photos you have posted on the listing remain there, unless the photo itself is the reason for the termination or you delete it yourself before the end; you can also ask for its removal afterwards via the contact address.
- In all cases, article 7.3 paragraph 6 applies to publications that have already been made. Provisions that by their nature are intended to continue after the end remain in force, including articles 7.3 paragraph 6, 7.6, 7.7, 9, 13 and 16.
15. Changes to these terms and versions
- We may amend these terms. Every version bears a version number and a date from which it applies; the current version is always on this page, and earlier versions remain available via the archive at the top.
- A change that materially affects your rights or obligations we announce at least 30 days before the effective date to account holders, by email or in the app or the portal. For users without an account, publication on this page suffices.
- If you keep using the service after the effective date, the new version applies to you. If you disagree with a change, you can stop using the service and delete your account before the effective date; until that moment the old version applies to you.
- Changes that are merely linguistic or clarifying, or that are necessary because of a change in the law, may take effect without a notice period.
- If we materially change the licence in article 7.3 or the house rules, the app or the portal asks you again for acceptance before you post content again.
16. Governing law, competent court and complaints
- These terms and the use of the service are governed by Dutch law.
- If you are a consumer and live in another country of the European Union, you retain the protection of the mandatory provisions of the law of your own country.
- Complaints. If you have a complaint about Refinds, first contact us (article 17); we confirm your complaint and let you know what we are doing with it. Refinds is not affiliated with any body for out-of-court dispute resolution.
- Competent court.
- For business users, the District Court of Gelderland (Rechtbank Gelderland) has exclusive jurisdiction.
- For consumers who live in the Netherlands, the District Court of Gelderland (Rechtbank Gelderland) has jurisdiction, unless, within one month after we have invoked this clause in writing, you choose the court that has jurisdiction under the law.
- For consumers who live in another country of the European Union, the court designated by the European rules has jurisdiction; in any case you can bring a dispute before the court of your own place of residence, and Refinds can summon you only there.
Where these terms say "get in touch" or "the contact address", we mean the channels in Contact in the privacy statement. That is where the email address and the contact form are set out together, along with the period within which you receive an answer. We deliberately do not repeat them here, so that two lists can never arise that drift apart. The reporting address for content is in article 8 paragraph 2.
18. Who offers Refinds
| |
|---|
| Provider | A. Ferwerda, trading as Refinds.eu |
| Postal address | Refinds.eu, Box C2366, Keurenplein 41, 1069 CD Amsterdam, Netherlands (post box) |
| Email | support@refinds.eu |
The same details appear in privacy statement §1, which is the leading document on this point.
19. Final provisions
- If a provision of these terms is void or is annulled, the remaining provisions continue to apply. For the affected provision, what the law permits and what comes closest to the purpose of that provision then applies.
- Refinds may transfer its rights and obligations under these terms to a successor who continues the service, for example on the registration of a business. We let account holders know; your rights do not change as a result.
- The fact that we do not enforce a provision, or do not enforce it immediately, does not mean that we waive it.
- These terms, together with the additional terms and the privacy statement, constitute the entire agreement between you and Refinds on the use of the service.
